  • 依據花蓮縣政府111年9月7日府人訓字第1110179097號函轉銓敘部111年8月29日部銓四字第11154849531號辦理。
  • 查公務人員留職停薪辦法(以下簡稱留職停薪辦法)第4條第 1項規定：「公務人員有下列情事之一者，應予留職停薪： ……二、選送國內外進修，期滿後經奉准延長。三、經核 准自行申請國內外全時進修，其進修項目經服務機關學校 認定與業務有關。……」第5條第1項規定：「公務人員有 下列情事之一者，得申請留職停薪，除第1款及第2款各機 關不得拒絕外，其餘各款由各機關考量業務運作及個案實 際情況依權責辦理：一、養育3足歲以下子女。二、……與 收養兒童先行共同生活，其共同生活期間依前款規定申請 留職停薪。三、照顧3足歲以下孫子女。但以該孫子女無法 受雙親適當養育或有特殊事由者為限。四、本人或配偶之 直系血親尊親屬年滿65歲以上或重大傷病，且須侍奉。 五、配偶或子女重大傷病須照護。六、配偶經服務之公私部門派赴國外執行政府工作、因政府公務需要指派或獲取 政府公費補助出國進修研究，其期間在1年以上須隨同前 往。……八、其他經考試院會同行政院認定之情事。」第7 條第4項規定，留職停薪人員於留職停薪期間因留職停薪原 因消失，應向服務機關申請回職復薪；如未申請回職復薪 者，服務機關應即查處，並通知其回職復薪(按：公務人員 任用法第28條之1業將公務人員留職停薪原因消失後之「復 職」修正為「回職復薪」)。
  • 茲為鼓勵公務人員增進個人知能、追求自我成長，並考量 留職停薪期間係保留職缺，且未支薪，故放寬公務人員依 留職停薪辦法第5條第1項第1款至第6款規定及考試院、行 政院110年6月29日考臺組貳一字第11000043021號、院授人 培字第11000015392號令等辦理留職停薪者，於留職停薪期 間得從事進修，惟權責機關仍應就個案實際情形審究有無 留職停薪原因消失之情形，如有留職停薪原因消失之情 形，應依留職停薪辦法第7條第4項規定通知其回職復薪； 又其回職復薪後，倘符合留職停薪辦法第4條第1項第3款規 定，亦得於回職復薪後，再以進修事由辦理留職停薪。
