主旨： 重申學校應透過以正向、合理且符合教育法規之方式落實零體罰政策，積極教育及輔導學生並維護學生受教權益，請各校確實依規辦理，詳如說明，請查照。
說明：  
一、 依據教育部國民及學前教育署111年2月21日臺教國署學字第1110021830號函辦理。
二、 教育基本法第8條規定略以：「學生之學習權、受教育權、身體自主權及人格發展權應予保障，並使學生不受任何體罰及霸凌行為，造成身心之侵害」，合先敘明。
三、 邇來仍時有教師違法處罰（體罰）及學校行政單位延遲、隱匿通報案件之情，請學校落實「教育基本法」規定，並依「教師法」等相關法規進行通報及查明妥處疑似案件。
四、 倘學校端知悉疑有體罰案件肇生，通報法規依據臚列如下：
(一) 校園安全及災害事件通報作業要點第6點規定略以（以下稱通報作業要點）：「依法規通報事件，應於知悉後於校安通報網通報，至遲不得逾24小時。」
(二) 兒童及少年福利與權益保障法（以下稱兒少法）第53條規定略以：「執行業務時知悉兒童及少年有遭受身心虐待者，應立即向直轄市、縣（市）主管機關通報，至遲不得超過24小時。」
(三) 上開案件倘延遲、隱匿或未通報者，則可依通報作業要點第12點及兒少法第100條予以檢討議處或由主管機關實施裁罰。
五、 承上，疑似體罰案件之處理流程等則應依下列法規辦理：
(一) 處理流程：
１、 高級中等以下學校教師解聘不續聘停聘或資遣辦法第4條。
２、 行政程序法第6節。
(二) 案件經查證屬實者，應依下列規定予以適法性之處置：
１、 教師法第4章略以：予以解聘、停聘等處分。
２、 公立高級中等以下學校教師成績考核辦法第6條規定略以：「予以記大過、記過、申誡等懲處。」
３、 兒少法第97條規定略以：「違反第49條第1項各款規定之一者，處新臺幣六萬元以上六十萬元以下罰鍰，並得公布其姓名或名稱。」
４、 學校訂定教師輔導與管教學生辦法注意事項第42點第2項規定略以：「教師違反教育基本法第8條第2項規定，以體罰或其他方式違法處罰學生，造成其身心侵害者，學校應按情節輕重，依教師法、學校教師成績考核辦法或相關規定處理。」
六、 有關涉及兒少法案件同步通報等相關事宜，請學校確實依規定辦理；如有疑問建請洽本府社會處，俾利處理程序完善。
七、 綜上，為落實教育部零體罰政策及積極維護學生受教權益，請學校確依相關規範處理上開案件，亦請積極協助學校教師提升輔導與管教知能，增進瞭解學生輔導與管教理念及法規，強化正確處理學生事務之專業知能，並於相關會議、研習、座談會中宣導正向管教，以創造友善校園學習環境。
